A 24-year-old Indianapolis woman sustained severe injuries, on March 21, 2016, on the city’s north side near the intersection of West 86th Street and Township Line Road after being struck by multiple vehicles.  The Indianapolis woman was pronounced dead at the scene of the collision by Indianapolis Metro Police officials, after being struck by a min-van while attempting to cross the street.  Although the driver of the mini-van immediately stopped and remained at the scene of the collision to speak with law enforcement officials, witnesses stated that after being struck by the mini-van at least one other vehicle struck the Indianapolis woman although no other vehicle involved in the subsequent collisions stopped at the scene.  Additionally, eyewitnesses at the scene identified an older brown work van with a ladder on the back as another vehicle which collided the pedestrian, and the Indianapolis Metropolitan Police Department has asked for any person with information on this vehicle or driver to contact their office.

Each year, the National Highway Traffic Safety Association reports nearly 5,000 deaths occur due to collisions involving pedestrians within the United States.  Additionally, in determining civil liability for these types of collisions, a common misconception held by some is that a pedestrian always has the right of way when crossing a roadway.  However, in Indiana pedestrians have a legal duty to obey all traffic control signals and pedestrian signals, in addition to a general duty to yield the right of way to motor vehicles while walking upon the roadway, with limited exceptions. So as the spring season brings more pedestrian traffic and activity, we at Schiller Law request that both motorists and pedestrians share the road and contact our experienced legal team at 888-578-3100 or at IndyInjured.com, if you are a loved one are injured due to the negligence of another while on the road.
